Abstract

Supporters of the rapidly rising field of alternative dispute resolution argue that the traditional litigation system is not working. Their main contention is that the present system is too congested, too costly, and too slow. Arguably, other dispute resolution systems would be more efficient. One of the most highly touted alternatives is to provide for a panel of "neutral experts" who will screen and perhaps mediate or arbitrate the civil dispute. The mediation-arbitration expert panel has been particularly popular in the medical malpractice area.
