Abstract
In the thirty-six states with capital punishment statutes, there are presently 2774 inmates on death row On average, these prisoners will spend eight years on death row awaiting execution while challenging their sentences. This extended delay is not surprising considering the multiple levels of appeal available. State prisoners may challenge their sentence on direct appeal, state, and federal habeas corpus petitions.
