Abstract

The most fundamental challenge to the application of antitrust to health care issues has been whether the principles that underpin antitrust analysis lend themselves to the analysis of the health care industry. The argument is sometimes made that they do not because health care is a "special case." First, unlike consumers of other commercial products, the consumer of health care has little ability to evaluate what he is getting and why. Second, a third party is usually paying the bill. Third, the physician-advisor stands to gain from the transaction. The special case argument, with supporting empirical research, questions whether increased competition leads to lower costs and better consumer outcomes in health care markets.
