Abstract

Each year, many capable lawyers appear for the first time in cases before Utah appellate courts. Those lawyers with prior appellate experience in other jurisdictions, and those with no such head start, are faced equally with the somewhat daunting task of quickly getting a grip on the way we do things here. With that in mind, we have written this article, intending it to be a "primer" in Utah appellate practice generally. We do not intend to examine comprehensively all there is to know about appellatepractice. Rather, we intend this piece to be an introduction to Utah appellate procedure, a "how-to" guide to help educate the inexperienced appellate lawyer, whether new to appellate practice generally or just Utah appellatepractice. Specifically, this article offers a basic overview of Utah's court structure, guidance on how to launch an appeal, a brief discussion of the common mistakes made by practitioners in appellate brief writing, and recommendations on how to avoid making these sometime fatal errors.
