Abstract

Absent legislative curtailment of existing general welfare provisions, Hutchinson means that local government officials will no longer have to wait for specific authority from the legislature before they can enact regulatory measures, nor waste valuable resources in efforts to convince state legislators of the need for enabling legislation. Past applications of Dillon's Rule were often inconsistent and created unreasonable restrictions on local government regulatory power. Hutchinson arguably corrects those problems.
