Abstract
Sindell removed a major impediment for the plaintiff seeking a remedy for injuries caused by fungible products that were produced by a number of manufacturers. Although based on well-recognized policies favoring the liability of an enterprise for the losses it causes, the decision raises serious concerns about its impact on tort law, the drug industry, insurance costs and the courts. It remains to be seen whether the Sindell solution to causation impediments will lead to a proliferation of suits seeking to hold entire industries liable for their defective products.
