Abstract

Custody decisions have become a source of frustration for parents, mental health professionals and the courts. In many instances, judges are forced to choose the "best" solution in a no-win situation. The choice is often between two equally qualified parents who both love and wish to care for their children. In order to meet the needs of parents and children, judges and others are seeking new solutions to ease some of the dilemmas faced in a custody battle. This Essay discusses one such proposal: joint custody. Joint custody is when both parents share the responsibilities of child custody. This Essay describes different joint custody arrangements and examines the social science findings on the effectiveness and appropriateness of joint custody. In addition, this Essay addresses issues raised by joint custody and the legal system's response to this new child care concept.
