Abstract

Since the publication of Part 1 of this Article, an amendment to the Utah Constitution revamped the judicial article, expressly giving the Utah Supreme Court primary authority for the adoption of rules of evidence and procedure. Now the legislature can amend the supreme court rules of evidence and procedure only by twothirds vote of all members of both houses. Consequently, except in rare instances, the supreme court will be the exclusive authority on developing evidence law.
