Abstract

Since the early 1970s, the United States has witnessed an unprecedented effort on the part of the various Indian tribes to define and enlarge the scope of inherent tribal power. This phenomenon derives its strength from at least two sources, the most influential of which is the present federal policy of Indian self-determination and self-government. Beginning with the enactment of the Indian Reorganization Act and, more recently, the Indian Civil Rights Act ("ICRA"), Congress has determined that the best course for the American Indian tribes is one aimed at enhancing their status as sovereign entities.
