Abstract

As a result of two 1987 United States Supreme Court decisions, many victims of national or ethnic origin discrimination now have access to the remedies provided by Congress under section 1981 and section 1982, title 42, of the United States Code. The decisions, Saint Francis College v. Al-Khazraji and Shaare Tefila Congregation v. Cobb, represent a not entirely successful attempt by the Court to resolve a century-long dispute among the federal circuits over the meaning of the term "white citizen" in sections 1981 and 1982.
