Abstract

The Utah Hazardous Substances Mitigation Act provides a mechanism for cleaning up hazardous substances in Utah. The Utah Legislature enacted the HSMA to address three objectives. First, the drafters of the HSMA sought to give the state more control over hazardous substance cleanups. Second, the drafters wanted to provide a funding mechanism for cleanups. Third, the drafters wanted better enforcement tools to encourage responsible parties to cleanup on their own, or alternatively, to settle with the state on the costs of cleanup.
